The Controller, as part of conducting its business related to the provision of services – telecommunication solutions for business communication, makes every effort to ensure an appropriate level of privacy protection for contacting persons, contractors, website users, and persons using our services.

If you contact our company or while using our Website or using our services, you provide us with your Personal Data – we then become their Controller.
The basis for our processing of your Personal Data may be:

- WHO IS THE RECIPIENT OF THE DATA OR TO WHOM WE CAN TRANSFER PERSONAL DATA
In connection with the provided services, we may transfer or share your Personal Data with entities cooperating with us, e.g., other companies belonging to our capital group, based on the legitimate interests of the controller, to respond to your inquiry, i.e., Tide Mobile Sp. z o.o. with its registered office at ul. Wiśniowa 8C, 05-500 Piaseczno, entered into the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS number: 0000839965, REGON: 385998454, NIP: 1231467744.
As a general rule, personal data is processed by us within the European Union and the European Economic Area. In connection with the provision of services, data may be transferred to third countries. However, you must know that in such a situation, the transfer of data by us takes place in compliance with all requirements specified in Chapter V of the GDPR – Transfers of personal data to third countries or international organizations. Then the processing can only take place provided an adequate level of data protection is ensured, e.g., by a decision of the European Commission that the level of data protection is adequate or, for example, based on the standard contractual clauses adopted by the European Commission.

If you wish to assert your rights, please direct correspondence to the details provided in sections 2-3 of the Policy. At the same time, we ask you to send all necessary information that will allow us to unambiguously identify the entity exercising the rights.
Every entity whose data the Controller processes has the right to:

- c) erasure of personal data (the right to be forgotten),
- d) restrict the processing of personal data,
- e) the right to data portability to another controller,
- f) the right to object to the processing of personal data,
- g) the right to lodge a complaint with the President of the Personal Data Protection Office,
- h) withdraw consent, which can be done at any time. The withdrawal of consent does not affect the processing of data carried out before its withdrawal. Consents may be revoked by them at any time, without affecting the lawfulness of the processing.
If it is considered that the processing of Personal Data violates applicable regulations, every entity has the right to lodge a complaint with the Supervisory Authority. For this purpose, you may contact the personal data protection office that is competent for your place of residence. You may also contact the Personal Data Protection Office (UODO).
The right to erasure of Personal Data, called the “right to be forgotten” – can be exercised in the following situations:
- The data are no longer necessary in relation to the purposes for which they were processed or are processed otherwise.
- You previously withdrew your consent to processing and we have no other legal ground for processing.
- You objected to the processing of data.
- The data have been unlawfully processed.
- The controller has a legal obligation to erase the data resulting from legal provisions.
- The data have been collected in relation to the offer of information society services.
The right to restriction of processing can be exercised when:
- You contest the accuracy of the data.
- The processing is unlawful, but you oppose their erasure and request restriction instead.

- a) to handle an inquiry, including providing the Controller’s offer [marketing purposes] based on the Controller’s legitimate interest, which is informing about provided services pursuant to Article 6(1)(f) of the EU Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter “GDPR”. Personal data will be processed for the period necessary to achieve the purpose – returning a reply, but no longer than: until an objection is raised,
- b) for the purpose necessary to take steps at the request of the data subject prior to entering into a contract [Article 6(1)(b) of the GDPR]. Personal data will be processed for the limitation period of claims,
- c) to handle an inquiry via chat on the tidesoftware.pl website (Article 6(1)(a) of the GDPR),
- d) if you give separate consents – for marketing purposes based on Article 6(1)(a) of the GDPR. Personal data will be processed for up to 24 months from granting it.

Your personal data may be subject to automated processing, including profiling of marketing messages in the advertising systems of such services as, e.g.: Google, Meta, LinkedIn. Personal data may be transferred outside the European Economic Area.
Privacy Policy – Privacy & Terms – Google
You provide us with your personal data voluntarily. However, it is a condition for us to be able to send you marketing information regarding the Controller’s offer. If you do not provide an e-mail address or phone number, we will not be able to present this information to you.
Your personal data obtained via chat on the www.tidesoftware.pl website are processed using AI technology in accordance with the Privacy Policy of the processor ElevenLabs — Read our Privacy Policy. Data may be processed outside the European Economic Area.
Scope of processed data:
Personal data provided in the content of the inquiry in the chatbot, audio recordings, text entered by the data subject, such as contact details – email address and/or phone number.
The data will be processed by the processor pursuant to Article 6(1)(a) to respond to the inquiry for a period of 3 months.
The data are processed by the processor based on a data processing agreement ElevenLabs — Discover our Data Processing Addendum (DPA).

We process personal data for the purpose related to handling your inquiry. We will process personal data based on a legitimate interest – handling your Application or Inquiry – pursuant to Article 6(1)(f) of the GDPR.
The recipients of your personal data may be employees/associates of the ADO, as well as, under separately concluded data processing agreements, entities providing legal services to the ADO. The recipient of the data may also be competent entities/administrative authorities entitled to receive your data on the basis of legal provisions.
Your personal data are stored for the time necessary to provide an answer, but no longer than until the expiry of the limitation period for claims, which period is no more than 6 years. The storage period will be extended by the limitation period for claims if the processing of your data is necessary to establish or assert possible claims or defend against such claims – for a maximum of 6 years.
Every entity whose personal data is processed by the ADO has the right to:
- a) access the content of personal data, including requesting a copy of it,
- b) the right to request rectification,
- c) the right to request the erasure of personal data (the right to be forgotten),
- d) the right to restrict the processing of personal data,
- e) the right to data portability to another controller,
- f) the right to withdraw consent – the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
Every entity whose personal data is processed by the ADO has the right to object to the processing of data for purposes resulting from the legitimate interests of the ADO – described in point 2 above. If you consider that the processing of your personal data by the Controller violates data protection regulations, you have the right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office.
The provided data are not profiled; decisions based on automated processing will not be made based on the provided data. Personal data are not transferred to an international organization or outside the EEA.
Providing personal data is voluntary, but necessary to respond to the inquiry.

Your personal data will be processed for the purpose of:
- a) fulfilling obligations resulting from legal provisions related to the employment process – including the Labor Code – in this respect, the legal basis is a legal obligation incumbent on the ADO, Article 6(1)(c), and for data not required by law – the legal basis for data processing is consent, Article 6(1)(a) of the GDPR,
- b) conducting future recruitment processes, if consent is given to the processing of data for this purpose – the legal basis for data processing is consent, Article 6(1)(a) of the GDPR,
- c) establishing or asserting claims or defending against claims by the ADO — the legal basis for processing is the legitimate interest of the ADO (Article 6(1)(f) of the GDPR) – the legitimate interest is to enable the defense of its rights.
The recipient of your personal data will be employees and associates, entities providing services to the ADO, including IT system and IT service providers, postal operators, and couriers.
Your data will be processed until the end of the recruitment process, and if processing is based on consent – until its withdrawal, whereby if consent is given to the processing of data for future recruitment purposes, the data will be processed for no longer than 6 months. The processing period may be extended each time by the limitation period for claims if the processing of your data is necessary to establish or assert possible claims or defend against such claims by the ADO.
Each given consent can be withdrawn at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. For evidentiary purposes, the ADO requests that consents be withdrawn in writing or electronically.
You have the right to: access the content of personal data, including requesting a copy thereof, and requesting their rectification, erasure of personal data (the right to be forgotten), restriction of the processing of personal data, the right to data portability to another controller, the right to object to data processing, as well as the right to lodge a complaint with the President of the Personal Data Protection Office if you consider that the processing of personal data violates the provisions of the GDPR. You have the right to object to the processing of personal data for the purposes specified in point 4 c) for reasons related to your particular situation. For evidentiary purposes, the ADO asks that objections be raised in writing or electronically.
Providing personal data is required by the provisions of the Labor Code. The consequence of failing to provide the data will be the inability to consider your candidacy in the recruitment process.
Information Clause – processing of data obtained through social media portals [Facebook/LinkedIn] of the controller’s external providers on websites

After this period, the data will be processed only to the extent and for the time required by law, including tax and accounting law – as a rule, no longer than 6 years from the performance of the contract. The period of processing personal data may be extended each time by the limitation period for claims if the processing of personal data is necessary to pursue possible claims or defend against such claims by the ADO.

In a situation where you are the other Party to the transaction, a proxy, an employee of the entity with which the Controller has concluded a contract, the data was provided by the other Party to the transaction, the Controller’s Client, whom you represent/are an employee/associate of, or was obtained from public registers (e.g., registers of entrepreneurs, court KRS/CEIDG) in connection with the performance of the contract. We will process the following categories of personal data:
- a) for representing persons: first name(s) and last name, function in the representing body, position, e-mail address, phone number,
- b) for other persons: first name(s) and last name, e-mail address, phone number, position.
The ADO will process your personal data when it is necessary for purposes arising from the legitimate interests pursued by the ADO or a third party – based on Article 6(1)(f) of the GDPR – which the ADO considers to be: concluding and performing a commercial contract connecting the ADO and the entity you represent/whose employee/associate you are, as well as establishing, asserting, and defending against claims.
Personal data are stored for the time necessary to conclude and perform the commercial contract referred to above.
